1. Acceptance of these terms
By accessing or using CommonContent ("the site", reachable at commoncontent.org), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, please do not use the site. We may update these Terms from time to time; the most recent version will always be posted on this page.
2. Nature of the service
CommonContent is a catalog of pointers to works released under Creative Commons licenses or placed in the public domain. We do not host, redistribute, or warrant the underlying files; we maintain metadata that links to the original sources.
3. Contributions
By submitting an entry to the catalog, you represent and warrant that:
- you are the rights holder of the work, or have explicit authorization from the rights holder;
- the work is genuinely available under the Creative Commons license you indicate, at the URL you provide;
- your submission does not infringe any third-party right and does not contain unlawful, defamatory, or harmful content;
- you grant CommonContent the right to display the metadata you provide on the catalog and in syndication feeds.
We reserve the right to edit, reclassify, hold for moderation, or remove any submission that violates these Terms or the spirit of the catalog.
4. Use of catalog content
Each entry in the catalog points to an externally hosted work. Your use of that work is governed by the license attached to it by its creator. You are responsible for reading and complying with the applicable license, including any attribution, share-alike, non-commercial, or no-derivatives conditions.
5. Intellectual property of the site
The CommonContent site design and original editorial content are licensed under the Creative Commons Attribution License (CC BY 4.0), except where otherwise noted. The CommonContent name, logo, and trade dress remain reserved.
6. Disclaimer of warranties
The site is provided "as is" and "as available". We make no warranties, express or implied, regarding the accuracy, completeness, availability, or fitness for a particular purpose of the catalog or any linked work. Catalog entries reflect what contributors have stated; we do not independently verify every claim of authorship or licensing.
7. Limitation of liability
To the fullest extent permitted by law, CommonContent and its volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the site or any work catalogued on it.
8. Acceptable use
You may not use the site to: submit spam or repeated low-quality entries; harass other users; circumvent moderation; misrepresent authorship or licensing; or otherwise violate applicable law. Accounts that abuse the catalog may be suspended.
9. DMCA / takedown
If you believe an entry on the catalog points to material that infringes your copyright, or misrepresents the license under which a work has been released, please contact us with the relevant URLs and a statement of your rights, and we will investigate promptly.
10. Governing law
These Terms are governed by the laws applicable in the jurisdiction in which CommonContent is operated, without regard to conflict-of-law principles. Any disputes will be resolved in that jurisdiction's competent courts.
11. Changes to the catalog or the site
We may add, change, suspend, or discontinue any aspect of the site at any time, without notice. We may also retire entries that no longer point to a working source URL.
